Notes: A code of conduct for elected officials is a reasonable idea, and much of this ordinance is straightforward. That said, a few sections raise questions that I think are worth considering as this moves through the process:

  • Subjective language around nonverbal behavior (167.04): Prohibiting “scowling” and “facial expressions that suggest ridicule or contempt” is vague. Who decides what counts as a scowl versus concentration? This could invite selective enforcement.

  • Private conduct extension (167.08): Requiring respectful behavior “in private conversations related to Village business” and reminding officials they’re “always on display” and may be “eavesdropped upon” seems to extend a bit far.

  • The prohibition on publicly criticizing staff (167.09): While protecting employees from public berating makes sense, council members should be able to raise legitimate performance concerns publicly.

  • The penalty structure (167.11): A simple majority can strip voting rights for up to three months. Without clearer due process safeguards, this could be used against dissenting voices.
